Welcome to the DvG experience APP, owned by Virtuous Virtual Reality Gaming (“VVRG”). This page informs you of our policies regarding the collection, use, and disclosure of personal data when you experience DvG and the choices you have associated with that data.

 

This Privacy Policy applies to both the DvG virtual reality experience and the website www.virtuousvrgaming.com.

Note that your use of the DvG virtual reality experience may also be subject to additional terms and conditions. For example, you should review and agree to https://unity3d.com/legal/privacy-policy, as in experiencing the DvG virtual reality experience, your personal data may also be processed by Unity, which ensures the creation and management of statistics.

Please read the entire Privacy Policy carefully before experiencing DvG or accessing the website. Without any additional action on your part, your use of, access or viewing of, or submission of any content to or through DvG is subject to, and constitutes your acceptance of and agreement with, these terms.

 

With our commitment to provide our users with the highest quality service, you can be assured that we will protect your online privacy as stated in the terms of this policy. The Privacy Policy does not apply to written correspondence or telephone conversations, or any other method of obtaining information that you voluntarily provide to us, but strictly to data gathered online from DvG.

What Data We Collect In General. Some features on DvG ask you for your basic, non-sensitive, personal data. This information currently includes, but is not limited to first and last name, address, phone number, email address and address information. This data is collected during the following types of activities you may undertake on DvG:

 

  • Submitting user generated content on any part of DvG that permits it

  • Signing up for emails/newsletters offered by DvG/VVRG.

  • Participating on social media accounts

  • Knowingly volunteering information on any other part of DvG (e.g., request for customer service)

 

Data for and During Your DvG Experience. Additionally, so that you can maximize your DvG virtual reality experience  and we are able to repair and improve the APP and experience,  we collect the following data about you during your experience:  identification data (Avatar, nickname or UserID under which you are registered, etc.); technical data (data about your device, etc.); data concerning your DvG experience (when and how and how successfully you experience DvG).

 

We need this information so that the experience is functional. For this purpose, we are going to process the information (especially statistics) in aggregated (non-identifiable) form as much as possible and where this is not possible, we are going to process the information in pseudonymized form as much as possible.

We may also capture certain non-personal data such as the browser, operating system or the type of search engine you are using. We may also collect general demographic data which helps create a broad picture of our population rather than focusing on any one individual.

DvG/VVRG does not knowingly collect any personal information from individuals under the age of 16. If you are a parent or legal guardian who has discovered that your child has provided personal information without your consent, you can ask us to remove any unauthorized information provided by your child by contacting us at info@virtuousvrgaming.com.

 

In addition to the above reasons, we need to know your basic personal information in order to provide you with the requested service. We will not collect any personal data from you that we do not need to provide and oversee this service.

 

How We Otherwise Use This Data. We use this data to better serve our users. For example, the data gathered might be used when updating information on DvG. We may use the data you provide to fulfill service requests or to respond to inquiries about offerings. This data is used to continually refine our content and to identify the most popular areas of our Website. We may use the data to offer other products, programs or services that may be of interest to you.

To better provide products and services that would interest you, we may combine information we receive with outside records to enhance our ability to market those products or services.

Collected information is stored on DvG hosting company’s computers and accessible by authorized users and personnel. In order to safeguard your non-public personal data, DvG/VVRG maintains physical, electronic, and procedural safeguards that comply with industry standards.

Third-Party Service Providers – DvG/VVRG engages third party service providers to perform functions on its behalf, such as website hosting, marketing, analytics, etc. These entities have access to your personal data only as needed to perform their functions and they are obligated to maintain the confidentiality and security of that personal information. Each of these entities has their own applicable terms of service and privacy policies. Third Parties With Whom We Do Business – DvG/VVRG may share your personal information with certain third parties with whom it does business, such as promotional co-sponsors, so that they can provide you with special offers, promotional materials, and similar materials that may be of interest to you. Although our treatment of your personal data is governed by this Privacy Policy, the third party’s treatment of your personal data will be governed by its privacy policy.

Disclosure Required By Law – DvG/VVRG may also use or disclose personal data if required to do so by law or in the good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal process served on DvG/VVRG; (b) protect and defend our rights or property, DvG or our users, and (c) act under emergency circumstances to protect the personal safety of us, our affiliates, agents, or the users of DvG or the public.

Retention - We will keep your personal data for as long as it is necessary to fulfil the purposes for which it was collected as described above and in accordance with applicable law.

 

At a minimum, we retain it only for the time for which you experience DvG and at the maximum until you delete your account on any platform which you used to experience DvG or until you ensure complete erasure of DvG from your library on any given platform. However, even then, most of the data is kept in the aggregate form only (when you cannot be identified) and only for as long as necessary.

In addition, we may retain your information for an additional period as is permitted or required to, among other things, comply with our legal obligations, resolve disputes, and enforce agreements. Where and when required by applicable law, we shall delete your information. Even if we delete your data from active databases, the information may remain on backup or storage media.

Oculus APP Permissions.

In order for DvG  to function properly, the app requires you to provide us with the following permissions for the Oculus headset.

android.permission.INTERNET: VVRG needs this permission for the application to run.

android.permission.ACCESS_NETWORK_STATE: VVRG needs this permission because we are checking if our application is not connected to the internet. If it is offline online features will not come.

android.permission.RECORD_AUDIO: VVRG needs this permission for voice chat, we are not collecting voice data.

android.permission.MODIFY_AUDIO_SETTINGS: VVRG needs this permission to control the audio volume.

android.permission.WRITE_EXTERNAL_STORAGE: VVRG needs this permission to sign in and cache.

android.permission.READ_MEDIA_AUDIO: VVRG needs this permission for playing local video.

android.permission.READ_MEDIA_VIDEO: VVRG needs this permission for playing local video.

android.permission.READ_MEDIA_IMAGES: VVRG needs this permission for reading cache.

android.permission.ACCESS_MEDIA_LOCATION: VVRG needs this permission for the cache.

android.permission.READ_MEDIA_IMAGE: VVRG needs this permission for reading cache.

Website User Choice. DvG/VVRG allows users to opt-in to newsletters or email subscriptions that are of interest to them. DvG/VVRG uses email addresses for the purpose of informing subscribers of news and other related topics. If you no longer wish to receive such communications from DvG/VVRG, opt-out by clicking on the hyperlink at the bottom of any email you receive or you can send an email to info@virtuousvrgaming.com, requesting to be unsubscribed from any further emails. Please note that you cannot opt-out from emails regarding your account information.

 

Social Media. DvG may provide visitors with the ability to register, log into, “like” or otherwise interact with third party social media services, such as Facebook and Twitter. These features may enable integration and/or access to your social media accounts. DvG/VVRG does not control these social media services or your profiles on these services, and it does not establish privacy settings or rules for how your personal information on these services will be used. If you choose to log on to or submit information through any of these social media services, your personal information will be subject to the applicable social media service’s terms and conditions and the current privacy settings you have selected for such services. By accessing any social media service, you assume the risk that your personal information on that service may be viewed and/or used by third parties (known or unknown) for any purpose. You agree DvG/VVRG is not responsible for any acts or omissions by these social media service providers.

In addition, by choosing to log-in to our Website using your credentials from a social media service, you are asking that service to send DvG/VVRG certain information from your account with the service, and you authorize DvG/VVRG to collect, store and use such information in accordance with the terms of this Policy.

Use of Data Collection Tools. DvG/VVRG uses Pixel Tags to collect information about a user’s online activities over time and across different websites. DvG/VVRG employs a common technique usually referred to as “pixel tracking” to measure the effectiveness of marketing and advertisements, as well as to compile aggregate usage statistics. Pixel tracking, which may be used in connection with advertisements on other sites, on our Website or in e-mail messages, involves the use of pixel tags (also known as “clear gifs,” “Web beacons” or “1-by-1 gifs”) that are not visible to the user of DvG and consist of a few lines of computer coding. Personal data is not collected by pixel tracking, nor is any tracking information generated from the pixel tag allowed to be used for any other purpose other than to report Website activity to us.

A cookie is a piece of information that a web server may place on your computer when you visit a website. Cookies are commonly used by websites to improve the user experience and have not been known to transmit computer viruses or otherwise harm your computer. Many cookies last only through a single website session or visit. Others may have an expiration date or may remain on your computer until you delete them.

DvG/VVRG may opt to use cookies for a number of purposes - for example, to maintain continuity during a user session, to gather data about the usage of our Website for research and other purposes, to store your preferences for certain kinds of information and marketing, or to store a username or encrypted identification number so that you do not have to provide this information every time you return to our Website.

If DvG/VVRG decides to employ cookies, such cookies will track only your activity relating to your online activity on this Website and will not track your other Internet activity. You can decide if and how your computer will accept a cookie by configuring your preferences or options in your browser. If DvG/VVRG opts to employ cookies and you choose to reject these cookies, that may affect your use of our Website features. DvG/VVRG may decide to occasionally use other companies to set cookies on DvG and gather cookie information for us. We would then use the cookie information gathered by these companies in the same manner as stated above.

What are your rights? DvG/VVRG aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your personal data. Whenever possible, you can update your personal data directly within your account settings section. You can also request that we provide direct access to, or that we correct or delete, personal information we’ve collected from you. Please submit requests to access, update, or delete personal information associated with your account by emailing us at info@virtuousvrgaming.com. Note that we may ask you for additional information to help us verify who you are before completing your request. Security of Data. The security of your data is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

 

Operation of DvG and the Website. DvG is operated in and intended for use in the United States. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that information we collect will be transferred to and processed in the United States. By using DvG, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

 

European Resident Rights under the General Data Protection Regulation (“GDPR”)

GDPR gives you the following rights:

  • Request Access to your Personal Data. This allows you to receive a copy of your Personal Data and verify that we are lawfully processing that information.

When VVRG disclose personal information for a business purpose or a commercial purpose, We enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

Sale of Personal Information

As defined in the CCPA, "sell" and "sale" mean selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's personal information by the business to a third party for valuable consideration. This means that VVRG may have received some kind of benefit in return for sharing personal information, but not necessarily a monetary benefit.

Sale of Personal Information of Minors Under 16 Years of Age

VVRG does not knowingly collect personal information from minors under the age of 16 through our Service, although certain third-party websites that we link to may do so. These third-party websites have their own terms of use and privacy policies and VVRG encourage parents and legal guardians to monitor their children's Internet usage and instruct their children to never provide information on other websites without their permission.

VVRG does not sell the personal information of Consumers VVRG actually know are less than 16 years of age, unless VVRG receive affirmative authorization (the "right to opt-in") from either the Consumer who is between 13 and 16 years of age or the parent or guardian of a Consumer less than 13 years of age. Consumers who opt into the sale of personal information may opt out of future sales at any time. To exercise the right to opt out, You (or Your authorized representative) may submit a request to VVRG by contacting Us.

If You have reason to believe that a child under the age of 13 (or 16) has provided VVRG with personal information, please contact Us with sufficient detail to enable Us to delete that information.

Your Rights under the CCPA

The CCPA provides California residents with specific rights regarding their personal information. If You are a resident of California, You have the following rights:

Once VVRG receive and confirm Your request, VVRG will delete (and direct Our Service Providers to delete) Your personal information from our records, unless an exception applies. VVRG may deny Your deletion request if retaining the information is necessary for Us or Our Service Providers to:

    • Complete the transaction for which VVRG collected the personal information, provide a good or service that You requested, take actions reasonably anticipated within the context of our ongoing business relationship with You, or otherwise perform our contract with You.

    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

    • Debug products to identify and repair errors that impair existing intended functionality.

    • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

    • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

    • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement if You previously provided informed consent.

    • Enable solely internal uses that are reasonably aligned with consumer expectations based on Your relationship with Us.

    • Comply with a legal obligation.

    • Make other internal and lawful uses of that information that are compatible with the context in which You provided it.

  • The right not to be discriminated against. You have the right not to be discriminated against for exercising any of Your consumer's rights, including by:

    • Denying goods or services to You

    • Charging different prices or rates for goods or services, including the use of discounts or other benefits or imposing penalties

    • Providing a different level or quality of goods or services to You

    • Suggesting that You will receive a different price or rate for goods or services or a different level or quality of goods or services

Exercising Your CCPA Data Protection Rights

Provide sufficient information that allows Us to reasonably verify You are the person about whom We collected personal information or an authorized representative

Your request to VVRG must:

  • Provide sufficient information that allows VVRG to reasonably verify You are the person about whom We collected personal information or an authorized representative

  • Describe Your request with sufficient detail that allows VVRG to properly understand, evaluate, and respond to it

 

VVRG cannot respond to Your request or provide You with the required information if we cannot:

  • Verify Your identity or authority to make the request

  • And confirm that the personal information relates to You

  • We will disclose and deliver the required information free of charge within 45 days of receiving Your verifiable request. The period to provide the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice.

Any disclosures VVRG provides will only cover the 12-month period preceding the verifiable request's receipt.

For data portability requests, VVRG will select a format to provide Your personal information that is readily usable and should allow You to transmit the information from one entity to another entity without hindrance.

Do Not Sell My Personal Information
